If a person has been convicted of a sex crime in Las Vegas, one of the penalties include registration in the Nevada Sex Offender Registry. One of the most common questions we receive is, “Do I have to register as a sex offender for the rest of my life?”
The answer: It depends.
All convicted sex offenders in Nevada are rated on a risk assessment scale. Tier I offenders are considered to pose the lowest risk and are least likely to commit another offense, while Tier III is the highest risk and are most likely to re-offend.
Here is a closer look at the details of each tier level:
- Tier I Offender - Typically applies to misdemeanors, gross misdemeanors, and any other non-violent convictions that do not involve children and are not listed under Tier II or Tier III definitions. The full period of registration for a Tier I offender is 15 years.
- Tier II Offender - Often applies to non-violent crimes involving children, such as sexual abuse of a child, child pornography, felony luring a child, prostituting a child and an offense involving sex trafficking. The full period of registration for a Tier II offender is 25 years.
- Tier III Offender - Applies to the most serious violent and non-violent sex crime convictions, including sexual assault, first-degree murder committed in the perpetration or attempted perpetration of sexual assault or sexual abuse, battery with intent to commit sexual assault, sexually abusing a child under 13 years of age, kidnapping, and any sex crime against a child after the person becomes a Tier II offender. The full period of registration for Tier III offenders is life.
Keep in mind, the public has access to only information for Tier II and Tier III offenders. The registry cannot disclose any online information about Tier I offenders.
