Under Nevada law, pandering, commonly called “pimping,” is illegal. This offense is prosecuted much more harshly than prostitution crimes. Whereas engaging in or soliciting prostitution is a misdemeanor, pandering is a felony.
Pandering Defined
According to N.R.S. 201.300, pandering is defined as persuading another individual, without using or threatening to use force, to engage in sexual conduct for pay. It is also unlawful to compel someone else to enter an establishment known to practice prostitution to have them perform sexual acts in exchange for money.
Pandering is a category C felony, which is punishable by up to 5 years in prison and up to $10,000 in fines. Additionally, the perpetrator may have to pay restitution to the alleged victim.
Sex Trafficking Is Also Unlawful
Also prohibited by statute 201.300 is sex trafficking. A person commits this offense when they induce or transport a child to engage in sexual conduct or enter an establishment that practices prostitution. An individual could also violate this section of the law if they recruit an adult when they know that threats, intimidation, or fraud will be used to force that person to perform sexual acts or enter a brothel for that purpose.
Violators could face different penalties depending on the age of the alleged victim:
- Sex trafficking an adult: category B felony, which is penalized by up to 10 years in prison
- Sex trafficking a child under 14 years of age: a category A felony, which could be punished by up to life in prison with the possibility of parole after a minimum of 15 years
- Sex trafficking a child between 14 and 15 years of age: category A felony penalized by up to life in prison with the possibility of parole after 10 years
- Sex trafficking a child between 16 and 17 years of age: category A felony, which is punishable by up to life in prison with the possibility of parole after 5 years
