Nevada is a “fault” state. This means whoever is liable for causing the collision is also responsible for compensating any losses suffered by any injured parties involved.

  • File claim through your own insurance company, which will then file a claim against the at-fault driver’s insurer 

  • File a claim directly with the liable driver’s insurer 

  • File a personal injury lawsuit against the liable driver 

If you wish to file a lawsuit against the at-fault driver, you have two years from the date of the accident to do so. When it comes to vehicle-related damage or other types of property damage stemming from a crash, a lawsuit must be filed within three years. However, it is imperative to file a claim or lawsuit as soon as possible. 

But what if the at-fault driver accuses you of causing or contributing to the crash? Nevada follows a “modified comparative negligence” rule, meaning your compensation can be reduced based on your percentage of negligence – if you are not more at fault compared to the other driver. 

For example, if a jury awards you $100,000 in damages, but also say that you were 25 percent to blame for the collision, then you will only walk away with $75,000 (or 75 percent of your total award). If your percentage of fault surpasses the other driver, then you are prohibited from recovering any damages.
